1. GENERAL

As a registered guest at Bandera Crossing Resort you assume the responsibility to inform your family, friends and visitors of Park Policies. You are responsible for the conduct and actions of party members including visitors at your site, and for maintaining compliance with all Rules, Regulations, Terms & Conditions while at Bandera Crossing Resort. Overnight visitors must register using the ‘Visitor Liability Waiver Form' provided. Park management reserves the right to evict without refund or refuse service to any person or persons who break or disregard any of the Rules, Regulations, Terms & Conditions.

Our property is a Designated Wildlife Management Area. Songbirds and bats are two target species at the property, and you'll notice bird houses, feeders, and bat houses scattered about to promote the habitat. Ringtail cats are also present and favor the hollowed dead trees which we've left in place for this reason. Please do explore and enjoy, but be respectful of the habitat and wildlife in the park.

River Usage: No lifeguard is on duty. Swim at your own risk. Glass or Styrofoam containers are not permitted at the river frontage or into the river. Help preserve our beautiful river frontage.
Children under 14 must be accompanied by an adult at all times.

Ground campfires are not permitted except in designated rock fire pits, or in self-contained firepits should you bring one. Please do not dump spent coals and ash on the property; let coals cool, and then put them in a trash bag tied and put into the dumpster.

Collection of dead wood on the grounds is prohibited and is strictly enforced to in order preserve and promote the habitat.

Overnight visitors must be identified and registered using the Visitor Liability Waiver and Registration Form and any fees due for additional persons, shall be paid.

Pets are permissible and appreciated but limited in number per site as identified in the separate RV and CABIN sections that follow. We ask that our guests maintain control of dogs and leash them outside. Unattended pets outside will be not be tolerated. Please clean up and dispose of pet waste to ensure the grounds are safe and enjoyable for everyone. The registered guest is financially responsible for all individuals or pets at their site for any / all damage to the park facilities.

Speed Limit: The speed limit in the park is 10 miles per hour. Use good discretion.

Minors must be accompanied by an adult after 9:00 p.m.

Quiet Hours are 10:00 p.m. to 8:00 a.m. Please respect the rules and your fellow campers.

Noise: Guests should understand that the Site will occasionally be exposed to noise from the onsite concert venue, and various motorsports or other events sponsored by the resort. These events will generally be published in advance on our website or Facebook page.

Firearms and Fireworks use are strictly prohibited in the park for the safety of all campers. No hunting is allowed.

Use: The Site shall not be used for commercial purposes or for any unlawful purpose and will be kept in good condition by Guest. Guest shall have sole responsibility to secure personal property owned by Guest. Guest shall not do or permit to be done any act which creates or may create a hazard, nuisance or an environmental problem in connection with Guest's use of the Site.

Security: No security is provided on site. It is up to you to lock your vehicle, RV, and equipment and keep other personal property secured.

Property and facilities damages: Guest is responsible for any damages the guest, guests visitors or pets, causes to the Property or facilities located on the Property, including but not limited to damages to water lines, electrical utilities, sewer line connections and other amenities. Guest is also specifically responsible for the damages he or she causes resulting in the clogging of the sewer line from Guest's recreational vehicle. If the cause of stoppage or damage is found to be the result of Customer's actions, all costs of the repair will be billed to Customer or added to Customer's rent.

Default: Any failure by Customer abide by rules, pay rent or other charges promptly when due or to comply with any other term or condition of this agreement shall, at the option of Bandera Crossing Resort, promptly terminate this agreement and forfeit all rights of Customer under this agreement.

Liability Limitation: All park facilities and equipment of the park is intended for the convenience of the guests. Any and all persons using the facilities do at THEIR OWN RISK and consent. The park management is NOT RESPONSIBLE for accidents due to fire, theft, wind, flood, personal negligence, acts of God or other unfortunate circumstances.

WAIVER, RELEASE, AND INDEMNITY: Guest hereby waives and releases Bandera Crossing Resort, Its Directors, Officers, Members, Shareholders, and employees from and against any claims for damages of any kind or type arising from the existing or future condition of the property or site. Customer hereby agrees to indemnify and hold harmless Bandera Crossing Inc., its Directors, Officers, Members, Shareholders and Employees (The "Indemnitees") from and against any and all claims for damages or loss to property or damages or claims of personal injury, including, but not limited to, attorney's fees arising from customer's, or any authorized party of Guest's, use of the Site or from use of the property, or from any activity or thing done, permitted or suffered to be done by customer in or on the site or about the property and for any damages or injuries caused by fire, water, wind, civil strife, acts of God, Guest's or any authorized party of Guest's actions or inactions or any other occurrence related to Guest's use or occupation of the Site or Property. These waivers, releases, indemnities, and agreements to defend shall apply regardless of the negligence, gross negligence, or strict liability of an indemnitee.



CHANGES TO THE AGREEMENT OR THE RULES, REGULATIONS AND/OR FEES ARE AT MANAGEMENT'S SOLE DISCRETION AND CAN BE MADE AT ANY TIME.



2. RV SITES

* CHECK IN TIME: 3:00 p.m.
* CHECK OUT TIME: 11:00 a.m.
* QUIET HOURS are 10:00 p.m. to 8:00 a.m. Please respect the rules and your fellow campers.
* SITE OCCUPANCY: Each RV site allows for up to four individuals and two vehicles. RVs must be no older than 10 years old and in generally good appearance and condition. All sites must remain neat and uncluttered. No grey water dumping on the ground is permitted. No vehicle repairs on site. Do not wash your vehicle or RV in the campground.
* PARKING: Two vehicles only per RV Site. Please park parallel to your RV out of the main drives. Out of respect to others at please stay in your own RV site. Additional vehicles may be parked in gravel overflow parking areas.
* PETS: Pets must be kept on a leash and under control at all times. Limit 2 dogs per site (without special permission) and must be non-aggressive. Pets are not to be tied outside unattended either at your site or elsewhere in the park at any time. No ground tie-downs permitted. If any pet demonstrates aggressive behavior toward another pet or guest, you will be asked to leave the campground. Please control excessive barking.
* VISITORS: Guests' overnight visitors must be preregistered at the office. Maximum of 6 people per RV site including visitors is allowed. Guests are responsible for their visitors compliance with park rules.
* TRASH: Please take all trash to the designated trash bins located throughout the Park. Please do not throw cigarette butts, coal, or other waste on the ground.
* SITE YARDS: For your safety, there is absolutely no digging, drilling, use of augers or driving stakes of any kind in the site yards or anywhere else on the property.
* UTILITIES: Water & sewer is included in all stays, as well as park-wide high speed WiFi.
* ELECTRIC: The Daily and Weekly rentals include electric. Monthly rates DO NOT include electricity. Charges for electric usage will be due each month and charged to the guest credit card or deducted from any deposit.
* CAMPFIRES are not permitted except in designated rock fire pits, or in self-contained firepits should you bring one. Collection of dead wood on the grounds strictly prohibited which is critical to preserve the wildlife habitat.
* BE COURTEOUS AND RESPECTFUL to your neighbors. Please follow only designated roads or walkways. Please do not cut through occupied RV sites. No drunk and disorderly behavior. Alcohol consumption by minors is not permitted.
* CANCELLATION POLICY: A credit card deposit equal to the first-nights registration charge is required to guarantee a reservation. The deposit is charged at the time of your reservation. If you are unable to honor your reservation, notify Bandera Crossing/BCIRVR.com (or call 281-701-9329) at least ten days prior to your arrival date to avoid deposit forfeiture. If canceled after the grace period, the guest is responsible for payment of the entire reservation. A credit voucher will be issued, valid for one year from reservation date.


3. CABINS
* CHECK IN TIME: 3:00 p.m.
* CHECK OUT TIME: 10:00 a.m.
* QUIET HOURS: 10:00 p.m. to 8:00 a.m. All minor children must be accompanied by an adult after 9:00 p.m.
* CABIN: One cabin allows for up to four individuals and two vehicles per site. All vehicles must be registered for stay at the site. NO SMOKING inside cabins. Smoking is allowed outside, please ensure proper disposal of cigarette butts. Please be mindful not to leave hot curling irons/hair straighteners plugged in.
* ENJOY OUR BEAUTIFUL RIVER FRONTAGE: No lifeguard is on duty. Swim at your own risk. Glass or Styrofoam containers are not allowed on the river. Children under 14 must be accompanied by an adult at all times.
* PETS: Maximum of 2 pets allowed in cabin with prior agreement. Guests are financially responsible for any damages caused. Pets must be kept on a leash at all times. Pets are not to be tied up and left unattended outside at any time. No ground tie-downs permitted. If any pet demonstrates aggressive behavior toward another pet or guest, you will be asked to leave the campground. No excessive barking is allowed.
* VISITORS: Guests' overnight visitors must be preregistered at the office. All guests are responsible for their visitors, and if extra visitors are found to be at your site without having registered, you and your visitors may be asked to leave the campground.
* TRASH: Please take all trash to the designated trash bins located throughout the Park. Please do not throw cigarette butts on the ground.
* UPON DEPARTURE: Please pick up and dispose of all trash and or cigarette butts in the area of your cabin. Please thoroughly wash, dry and return dishes to their original placement. Ensure all food is removed from refrigerator and/or freezer. Used towels or linens can be placed on the bathroom floor.
* FIREARMS AND FIREWORKS use are strictly prohibited in the park for the safety of all campers.
* CAMPFIRES are not permitted except in designated rock fire pits. Collection of deadwood on the grounds prohibited to preserve wildlife habitat.
* BE COURTEOUS AND RESPECTFUL to your neighbors. Please follow only designated roads or walkways. Please do not cut through occupied RV sites. No drunk and disorderly behavior. Alcohol consumption by minors is not permitted.

Visitor Liability Waiver and Registration Form

In consideration for myself and all persons entering under MY SUPERVISION (Visitors) being permitted to camp and participate in activities at Bandera Crossing Resort, I and all persons listed below in my party, agree to the following Waiver and Release:
I hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, IDEMNIFY AND HOLD HARMLESS, Bandera Crossing Resort, and all of its officers and employees, of any and all liability for injuries or losses sustained while on the premises. I acknowledge that camping has many hazards and that there are risks that cannot be eliminated, particularly in a wilderness environment.
I hereby acknowledge that Bandera Crossing Resort is not responsible for any theft, loss, damage or injury incurred during my stay.
My signature below confirms that I have read and agree to accept and abide by the Rules, Regulations, Terms & Conditions, including liability waivers, published by Bandera Crossing Resort pertaining to Guests and Visitors. I also understand that I can be asked to leave the property, without refund, for failure to follow the rules and regulations, a copy of which is posted on our website (bcirvr.com), and also posted and available at Bandera Crossing Resort.
I hereby consent to photographs and videos taken of me and all parties listed below during our stay at Bandera Crossing Resort for purposes of event documentation and promotion of Bandera Crossing Resort. Names will not be published without consent.

The http://bcirvr.com website (the "Site") is comprised of various web pages operated by Bandera Crossing Resort ("Bandera Crossing Resort"). http://bcirvr.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of http://bcirvr.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

The purpose of this website is to allow you to browse for more information about our property and the surrounding area as well as reserve any available rooms or units. 

  

Privacy

Your use of http://bcirvr.com is subject to Bandera Crossing Resort's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

 

Electronic Communications

Visiting http://bcirvr.com or sending emails to Bandera Crossing Resort constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

 

Children Under Thirteen

Bandera Crossing Resort does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use http://bcirvr.com only with permission of a parent or guardian.

By using any product, service or functionality originating from the http://bcirvr.com domain, you hereby acknowledge and consent that Bandera Crossing Resort may share such information and data with any third party with whom Bandera Crossing Resort has a contractual relationship to provide the requested product, service or functionality on behalf of http://bcirvr.com users and customers.

You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.
 
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Bandera Crossing Resort content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Bandera Crossing Resort and the copyright owner. International Users

The Service is controlled, operated and administered by Bandera Crossing Resort from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Bandera Crossing Resort Content accessed through http://bcirvr.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations. 

   

Indemnification

You agree to indemnify, defend and hold harmless Bandera Crossing Resort, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Bandera Crossing Resort reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Bandera Crossing Resort in asserting any available defenses.

 

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

 

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Bandera Crossing Resort agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

 

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. Bandera Crossing Resort AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
 
Bandera Crossing Resort AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. Bandera Crossing Resort AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
 
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Bandera Crossing Resort AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF Bandera Crossing Resort OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

 

Termination/Access Restriction

Bandera Crossing Resort reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Utah and you hereby consent to the exclusive jurisdiction and venue of courts in Utah in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
 
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Bandera Crossing Resort as a result of this agreement or use of the Site. Bandera Crossing Resort's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Bandera Crossing Resort's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Bandera Crossing Resort with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
 
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Bandera Crossing Resort with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Bandera Crossing Resort with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

 

Changes to Terms

Bandera Crossing Resort reserves the right, in its sole discretion, to change the Terms under which http://bcirvr.com is offered. The most current version of the Terms will supersede all previous versions. Bandera Crossing Resort encourages you to periodically review the Terms to stay informed of our updates.


GDPR Compliance Statement

Bandera Crossing Resort respects and complies with the EU General Data Protection Regulations (GDPR).

Consent
We explain what you're consenting to clearly and without ‘legalese', and ask that you explicitly consent to contact from us.

Breach Notification
In the case of a security break with regards to Bandera Crossing Resort, all guests and businesses of Bandera Crossing Resort are notified through our break notification system.

Right to Access
Bandera Crossing Resort does not share or sell your information with unauthorized outside third parties. You can ask for a digital copy of your information that we have on file as well as asking for it's removal.

Right to be Forgotten
You must opt-in to receive e-mails and communications from Bandera Crossing Resort. All e-mails have an unsubscribe option if you change your mind.


Data Portability
At any time you can request to have a copy of your data, have your data removed from Bandera Crossing Resort or ported to another controller of you choosing. 

 

Our California Consumer Privacy Act (CCPA) Policy

Effective January 1, 2020 the CCPA applies to businesses if one or more of the following are true:
  • Has gross annual revenues in excess of $25 million;
  • Buys, receives, or sells the personal information of 50,000 or more consumers, households, or devices;
  • Derives 50 percent or more of annual revenues from selling consumers' personal information.
